1. Applicability
1.1 These general terms and conditions apply to all agreements concluded between Back in Use and users of the webshop.
1.2 By using the Back in Use webshop, you agree to these general terms and conditions. If you do not agree to these terms and conditions, you must not use the webshop.
2. Account Registration
2.1 To use the full functionality of the webshop, you must create an account.
2.2 You are responsible for ensuring that the information you provide during registration is accurate and up to date.
2.3 Your account details are personal and may not be disclosed to third parties.
3. Product Information
3.1 Back in Use strives to provide accurate and complete information about the products offered on the webshop. Nevertheless, errors or inaccuracies may occur. Back in Use is not liable for any damage arising from incorrect or incomplete product information.
3.2 At the time of sale, the batteries of our laptops have a capacity of at least 70% of the original battery capacity. For tablets and smartphones, this minimum is 80%.
4. Orders
4.1 By placing an order in the webshop, you enter into a binding agreement with Back in Use.
4.2 Back in Use reserves the right to refuse or cancel orders without stating reasons.
4.3 Product prices and availability are subject to change without prior notice.
5. Payments
5.1 Payments in the webshop can be made using the payment methods offered.
5.2 All prices are stated in the currency indicated in the webshop and include applicable taxes, unless otherwise stated.
5.3 You are responsible for paying any import duties, taxes or other charges that may apply to your order.
5.4 Payments made using ecocheques must always be made using ecocheques issued in your own name. Back in Use reserves the right to refuse or cancel orders that do not meet this condition in the event of suspected identity fraud.
5.5 In the event of cancellation or return of an order paid for wholly or partially with ecocheques, the amount paid with Edenred will, where possible, be refunded to the original ecocheques balance. For payments made with Pluxee or Monizze, a refund through our payment processing system is not possible. For that part, Back in Use will offer the customer store credit equal to the amount paid.
6. Delivery
6.1 Back in Use strives to deliver orders as sustainably as possible, but does not guarantee the delivery time. However, we do strive to deliver your order within 5 business days.
6.2 The risk of loss of or damage to products passes to you at the time of delivery.
6.3 Any shipping costs will be stated during the ordering process, but are generally free of charge unless otherwise stated.
7. Returns
7.1 You have the right to return products within fourteen (14) days of receipt, in accordance with your statutory right of withdrawal, provided that they are in their original condition.
7.2 If you wish to return a product, you must notify Back in Use in advance and follow the return instructions.
7.3 The costs of return shipments are at your own expense, unless otherwise agreed.
7.4 In the event of cancellation or return of an order paid for wholly or partially with ecocheques, the amount paid with Edenred will, where possible, be refunded to the original ecocheques balance. For payments made with Pluxee or Monizze, a refund through our payment processing system is not possible. For that part, Back in Use will offer the customer store credit equal to the amount paid.
8. Warranty
8.1 Consumers benefit from a two-year statutory warranty on the device from the time of delivery, including for refurbished devices.
8.2 The statutory warranty applies to defects that mean the device does not meet what you may reasonably expect from it under normal use. This may also include defects in the hardware or battery.
8.3 Normal wear and tear, including a gradual decrease in battery capacity, does not in itself constitute a defect covered by the statutory warranty. Damage caused by improper use or external causes will be assessed on a case-by-case basis.
9. Intellectual Property
9.1 All intellectual property rights relating to the webshop and its content, such as texts, images and logos, are owned by Back in Use or its licensors.
9.2 You may not use or modify Back in Use's intellectual property without Back in Use's prior written consent.
10. Liability
10.1 Back in Use is not liable for any direct, indirect, incidental, special or consequential damage arising from the use of the webshop.
10.2 Back in Use is not responsible for any damage or loss resulting from the use of external links or websites linked to the webshop.
11. Applicable Law and Dispute Resolution
11.1 These general terms and conditions are governed by the law of the country in which Back in Use is established.
11.2 Disputes arising from these general terms and conditions will be submitted to the competent court of the place where Back in Use is established, unless mandatory statutory provisions require otherwise.
12. Amendments to the General Terms and Conditions
12.1 Back in Use reserves the right to amend these general terms and conditions at any time.
12.2 Amended terms and conditions will enter into force as soon as they are posted on the webshop.
12.3 It is the responsibility of visitors to the webshop to check the general terms and conditions regularly for any changes.
